Heart Eyes Terms of Use
Effective date: October 14, 2026
These Terms of Use ("Terms") are an agreement between you and SeptaSoft Solutions Inc., Milton, Ontario, Canada ("we", "us"). They govern your use of the Heart Eyes mobile app and related services ("Heart Eyes"). By using Heart Eyes, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, don't use Heart Eyes.
1. Who can use Heart Eyes
- Heart Eyes is offered in the United States and Canada. It's available only through the app stores in those countries, and may not be offered elsewhere.
- You must be at least 18 years old, and old enough to form a binding contract where you live. By confirming your age in the App, you promise that this is true.
- You may not use Heart Eyes if you've been banned from it before, or if the law prohibits you from using it.
- We may close any account we reasonably believe belongs to someone under 18.
2. What Heart Eyes is, and what it isn't
Companions are fictional AI characters. Every Heart Eyes companion is a fictional character created by our studio. Their replies are generated by artificial intelligence. They aren't real people, no human is writing to you, and they don't have real feelings, lives or experiences, even when they're written to seem that way. Companion photos are AI-generated images of fictional people, labelled as such. Any resemblance to a real person is unintended.
AI can be wrong. Replies may be inaccurate, inconsistent, outdated or inappropriate. Companions may "remember" things incorrectly or forget them. Don't rely on anything a companion says as fact.
Not professional advice. Heart Eyes is for entertainment and friendly conversation. Companions aren't therapists, counsellors, doctors, lawyers or financial advisers, and nothing in Heart Eyes is medical, psychological, legal or financial advice. Heart Eyes doesn't diagnose or treat any condition and isn't a substitute for professional care or human relationships.
Not an emergency service. Heart Eyes can't call for help, doesn't monitor conversations in real time, and can't respond to emergencies.
- If you're in danger, or thinking about harming yourself or someone else, contact local emergency services now.
- In the US, call or text 988 (988 Suicide & Crisis Lifeline) or call 911.
- In Canada, call or text 9-8-8 (9-8-8 Suicide Crisis Helpline, in English or French) or call 911.
- Elsewhere, find a local helpline at findahelpline.com.
If you mention thoughts of self-harm, harming someone else or an eating disorder, your companion will pause the conversation and share support resources, but that isn't a substitute for real help.
3. Your account
- Heart Eyes creates an account tied to your device when you first open it ("guest account"). You're responsible for activity on your device and account.
- If you delete the App or lose your device without a signed-in account, you may lose access to your conversations. Subscriptions can be restored through "Restore purchases"; conversations may not be recoverable.
- You can delete your account at any time in Profile → Delete account (see the Privacy Policy).
4. Acceptable use
Heart Eyes is a non-explicit service with a PG-13 maximum. When using Heart Eyes, you agree not to:
- Seek sexual content. Don't request, attempt to generate, or steer conversations towards sexually explicit content, nudity, sexual roleplay or sexualised images. This includes trying to get around our filters through wording, code words, role-play framing or "hypotheticals". Heart Eyes is romantic but never explicit: companions can be affectionate and flirty within PG-13, and photos you ask for can show fully clothed, mainstream fashion (for example a backless, strapless, off-shoulder or mini dress), but never nudity or implied nudity, lingerie or underwear, swimwear, sheer or see-through clothing, bed, bath or shower scenes, body-focused shots or sexual poses. We decline requests for those, and asking for them repeatedly or trying to get around our filters breaks these Terms.
- Involve minors in any sexual or romantic context. This includes asking a companion to role-play as, or describe, anyone under 18 in such a context. We report apparent child sexual exploitation material to the relevant authorities.
- Try to break the rules. Don't jailbreak, prompt-inject, or otherwise manipulate the AI or our systems to bypass safety measures, reveal system instructions, or produce prohibited content.
- Harass or harm others. Don't use Heart Eyes to create content that harasses, threatens, defames or doxxes a real person, or that promotes hatred against people based on protected characteristics.
- Promote violence or self-harm. Don't use Heart Eyes to plan, promote or glorify violence, terrorism, self-harm or eating disorders.
- Break the law. Don't use Heart Eyes for anything illegal, including fraud, or seeking instructions for weapons, drugs or other illegal activities.
- Impersonate or target real people. Don't try to make companions impersonate real, identifiable people, or share other people's private information.
- Misuse the service. Don't:
- scrape, reverse-engineer or overload Heart Eyes;
- use bots or automated scripts;
- resell or redistribute access;
- get around message limits or payment; or
- use AI outputs to build a competing product.
- Misrepresent AI output. Don't present companion output as written by a real person, or as professional advice, in a way that could mislead others.
We may block messages, limit features, or suspend or terminate accounts that break these rules (section 10).
5. Content moderation and reporting
- Automated filters. Messages and AI replies are checked automatically. A message that breaks our rules isn't sent. An AI reply that breaks our rules is withheld and replaced. Filters aren't perfect: they can occasionally block harmless messages or miss problematic ones.
- Report a message. If a companion says something offensive, sexual, harmful, hateful or inaccurate, press and hold the message and choose Report. Reports go to our moderation queue with the reported message and the conversation just before it. We use them to improve safety, and may act on your account or ours as appropriate.
- Other concerns: email support@septasoftcanada.com.
6. Your content and AI output
- Your messages belong to you. You give us a worldwide, non-exclusive, royalty-free licence to host, store, process and transmit them, and to create companion memory from them. The licence covers only operating, securing and improving Heart Eyes as described in the Privacy Policy, and ends when you delete the content, except for de-identified reports and backups as described there. We don't use your conversations to train AI models.
- AI output. Subject to these Terms and applicable law, you may use companion replies sent to you for personal, non-commercial purposes, such as sharing a screenshot of a chat moment. You may not use companion characters, names or images commercially. AI output may not be unique, and similar replies may be generated for other users.
- You're responsible for what you send, and for how you use output you share.
7. Our intellectual property
Heart Eyes, including its companion characters, names, personalities, backstories, artwork, portraits, photos, logos, software and design, is owned by SeptaSoft Solutions Inc. or its licensors and protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal non-commercial use, in line with these Terms and the rules of the app store you downloaded it from. All rights not expressly granted are reserved.
Feedback: if you send us ideas or suggestions, we may use them without obligation to you.
8. Subscriptions and payments
Plans. Heart Eyes is free to download, with a free plan that includes a limited number of messages per day and one companion. Heart Eyes Plus is an optional auto-renewing subscription that unlocks:
- unlimited messages, subject to a fair-use limit of 150 messages per day to prevent abuse;
- all companions;
- a monthly allowance of credits for photos and dates (see "Credits" below);
- voice notes, up to 30 per day and 300 per calendar month, and voice calls, up to 20 minutes per day and 300 minutes per calendar month (fair-use limits; a day runs from midnight to midnight, and a month is a calendar month, in the time zone your device reports to us, or in Coordinated Universal Time (UTC) until it has reported one; if you change time zone, the day in progress ends at the first midnight in the new time zone that falls at or after its usual end); and
- other features described in the App.
When you reach one of these limits you can add more for that day with credits (see "Extensions" below), or wait for the limit to reset.
It's offered weekly, monthly and annually. Prices are shown in the App before purchase, in your local currency (US dollars in the US, Canadian dollars in Canada), and may vary by region. Apple or Google adds any sales tax that applies where you live.
Billing by Apple or Google. Purchases are processed by Apple (App Store) or Google (Google Play), not by us. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. The store's terms of sale also apply.
Automatic renewal. Your subscription renews automatically at the end of each period (week, month or year), at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
Free trials. Some plans (for example, annual) may include a free trial. Unless you cancel at least 24 hours before the trial ends, it converts automatically to a paid subscription and you're charged. Any unused part of a free trial is forfeited when you buy a subscription. Trials are limited to one per person and per store account.
Cancelling. Cancel at any time in your device settings:
- iPhone: Settings → [your name] → Subscriptions.
- Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions.
Cancellation takes effect at the end of the current billing period, and you keep Plus benefits until then. Deleting the App or your Heart Eyes account doesn't cancel your subscription.
Refunds. Refunds are handled by Apple or Google under their policies. We can't issue refunds for store purchases ourselves.
- Apple: reportaproblem.apple.com.
- Google: through Google Play or play.google.com.
Except where required by law, payments are non-refundable and there are no refunds or credits for partial periods.
Price changes. We may change subscription prices. Apple or Google will notify you in advance as their rules require, and, where required, ask for your consent before a higher price applies.
Restore purchases. If you reinstall or change devices, tap "Restore purchases" on the subscription screen to restore an active subscription.
Credits (photos and dates). Credits are an in-App item you spend on companion photos (1 credit a photo, after your free photos), on dates (5 credits a date) and on some extras, such as more portrait options for a character you create after the free ones. The App shows what something costs before you spend credits on it, and costs may change. You get credits by buying a credit pack (a one-time purchase through Apple or Google) or, while you have Heart Eyes Plus, as a monthly allowance (the amount is shown in the App).
- No cash value. Credits aren't money. They can't be exchanged for cash, transferred to another account or person, or used outside Heart Eyes.
- Not refundable, except where the law requires it or through Apple's or Google's refund process (see "Refunds" above). If a store refunds a credit-pack purchase, we may remove the credits it added.
- Automatic credit refunds. If a photo or a set of portrait options you paid for can't be made, the credits (or the free photo) you used come back automatically. A date is three photos: if it can't start, or if only none or one of its photos comes out, all 5 credits come back; if two of the three come out, 2 credits come back. Your companion tells you in the chat at the end of the date.
- Expiry and your account. We don't currently put an expiry date on credits, and credits you already have stay in your balance if your Plus subscription ends. Unused credits are deleted with your account and aren't refunded.
- Extensions. While you have Heart Eyes Plus and reach a daily or monthly limit, you can spend credits to add more for that day: at present 50 more messages or 10 more voice notes for 1 credit, and 10 more minutes of voice calls for 2 credits (the App shows the current price and asks you to confirm before anything is spent). An extension adds to that day's allowance and lifts that month's limit by the part you use. Extensions last only until the end of the day they're bought (midnight in your time zone, as described under "Plans"): any part you haven't used then expires, isn't carried over and isn't refunded. Extensions have no cash value, can't be transferred, and aren't part of the subscription price. The free plan can't be extended.
EU/UK consumers. Where you have a statutory right to withdraw from a digital purchase, you agree that the subscription starts immediately on purchase, and you acknowledge that you lose the right of withdrawal once it has started, to the extent the law allows. Refund requests still go through Apple or Google.
Changes to features. We may change, add or remove features from the free plan or Heart Eyes Plus. If we materially reduce paid features during a subscription period you've paid for, we'll tell you, and you can cancel.
9. Changes to Heart Eyes and these Terms
Heart Eyes is evolving, and features (including companions) may change or be retired. We may update these Terms. If a change is material, we'll tell you in the App at least 14 days before it takes effect, except for changes needed for legal or safety reasons. Continuing to use Heart Eyes after the effective date means you accept the new Terms. If you don't agree, stop using Heart Eyes and delete your account.
10. Suspension and termination
- You can stop using Heart Eyes and delete your account at any time.
- We may suspend or terminate your access, or remove content, if you break these Terms, if required by law, or if needed to protect users, third parties or Heart Eyes. Where reasonable, we'll tell you why. If we terminate your account for a reason other than your breach, you can seek a refund from Apple or Google for any unused prepaid period, and we'll support that request where the store allows.
- We may discontinue Heart Eyes entirely with at least 30 days' notice in the App.
- Sections 6 (licence to your content, as limited), 7, 11, 12, 13, 15 and 16 survive termination.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, HEART EYES IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND THAT HEART EYES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. WE DON'T WARRANT THAT AI OUTPUT WILL BE ACCURATE, APPROPRIATE OR CONSISTENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- (a) WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO HEART EYES OR THESE TERMS; AND
- (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO HEART EYES WON'T EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID FOR HEART EYES IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (ii) US $50.
Some jurisdictions don't allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that can't be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or, for consumers in the EU and UK, your statutory rights.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless SeptaSoft Solutions Inc. and its officers, employees and agents from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of Heart Eyes. This doesn't apply to consumers where local law prohibits it.
14. Third-party services
Heart Eyes relies on third-party services (such as the app stores and cloud providers) that have their own terms. We're not responsible for third-party services we don't control.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Ontario have exclusive jurisdiction. If you're a consumer in the EU, the UK or another country whose laws give you the right to bring claims in your home courts or under your home-country consumer protection laws, nothing in these Terms takes away that right. Canada: if you live in a Canadian province or territory whose consumer protection law applies to you (for example Quebec's Consumer Protection Act, or Ontario's Consumer Protection Act, 2002), nothing in these Terms limits the rights it gives you.
16. Apple App Store additional terms
If you downloaded Heart Eyes from the Apple App Store:
- The Licensed Application End User License Agreement ("Standard EULA") at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ applies to your use of the App. These Terms supplement it. If they conflict, the Standard EULA governs, except where these Terms provide greater rights or detail that is consistent with it.
- These Terms are between you and SeptaSoft Solutions Inc. only, not Apple. Apple isn't responsible for Heart Eyes or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Apple isn't responsible for addressing any claims by you or any third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you aren't located in a country subject to a US Government embargo, or designated as a "terrorist supporting" country, and that you aren't on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
17. Google Play
If you downloaded Heart Eyes from Google Play, the Google Play Terms of Service also apply to your purchase. Google isn't a party to these Terms and isn't responsible for Heart Eyes.
18. General
- These Terms and the Privacy Policy are the entire agreement between you and us about Heart Eyes.
- If any provision is found unenforceable, the rest remains in effect.
- If we don't enforce a provision, that isn't a waiver of our right to do so later.
- You may not transfer these Terms. We may transfer them in connection with a merger, acquisition or sale of assets.
